Pham Cong Hung Nhan was homeless at the time of his arrest. He would collect scrap metal and other waste items to support himself.
Charged under Art. 351.
Pham Cong Hung Nhan was arrested by Ba Ria City, Vung Tau police on November 17, 2024, under Article 351 for "offending the national flag."
According to State media, Pham Hung Cong Nhan used his Facebook account “Hung Van Pham Cong” to regularly postsmany articles, images, and video clips with content that insults the national flag, distorts and defames the honor and dignity of the Party and State leaders; distorts the truth of revolutionary history; and denies the People's government and the socialist regime in Vietnam.
On December 9, 2023, Nhan collected scrap metal around Ba Ria City, then left it on the sidewalk in front of a house on Hung Vuong Street, Phuoc Nguyen Ward, Ba Ria City, and then went to drink coffee. When he returned, he found that the bag of scrap metal was missing and was angry.
Seeing the Vietnamese national flag on the gate of the house, Nhan broke the pole and took the flag and part of the pole to his temporary residence on an empty lot on Nguyen Tat Thanh Street, Phuoc Nguyen Ward. In the evening, while cooking rice on a makeshift stove on the sidewalk, Nhan put the flag in the stove, burned it, and used his phone to record the scene.
On December 10, 2023, Nhan used his phone to access Facebook and posted a video online to insult the Socialist Republic of Vietnam, calling on others to oppose the State.
